Compliance with Laws and Road Rules The Hirer must only use the Equipment in a manner consistent with its intended use, and must comply with all laws and road rules in force from time to time in the Territory, including the requirement to wear a helmet at all times when using the Equipment. Release The Hirer confirms they are competent in the use of the Equipment, and releases the Territory, its employees and agents from all liability or claims in respect of any loss, injury, death or damage to property which the Hirer may suffer as a result of the Hirer’s use of the Equipment under this Agreement except to the extent the Equipment is defective. Indemnity To the fullest extent possible, the Hirer indemnifies the Territory, its employees and agents against liability in respect of any, claim, action, demand, suit, or proceeding in connection with any loss, damage, injury or death to persons or property caused by the Hirer as a result of this Agreement, except to the extent the Territory caused or contributed to the relevant loss, damage or injury. Responsibility for loss, damage or theft The Hirer is responsible for returning the Equipment to the Territory in good condition subject to fair wear and tear and is liable for any damage, loss or theft of the Equipment during the Hire Period where the damage, loss or theft is a result of the negligence of the Hirer, including (but not limited to) leaving the Equipment unsecured and/or unsupervised. In the event of any damage, loss or theft of the Equipment, the Hirer agrees to pay for all costs associated with repairing or replacing part or all of the Equipment. If the Hirer experiences a flat tyre or other malfunction of the Equipment during the Hire Period, the Hirer must ensure they get themselves and the Equipment to a safe place and contact the Territory as soon as possible. The Territory will make all reasonable efforts to attend to the Hirer to repair or replace the Equipment as soon as possible. Late Fee If the Equipment is returned to the Territory after the end of the Hire Period, the Hirer will be charged a late fee Cancellations: Cancellations within 24 hours will incur a 100% hire fee.
